NON-COMPETE AGREEMENT; CALIFORNIA INJUNCTION PROHIBITING ENFORCEMENT IN OTHER STATES.  What happens when a California-based employer wants to hire out-of-state employees who are subject to non-compete agreements with the world's largest manufacturer of medical devices?  Colt / Wallerstein was lead counsel for a complex set of national lawsuits involving this non-compete agreement that was signed by more than 100,000 employees.  The manufacturer tried to prevent its former employees throughout the country from working for competitors for a period of 18 months.  Our firm obtained an unprecedented injunction in California that prohibited the company from enforcing the agreement in other states. This extended California's authority outside of the state and helped foster competition in the employee marketplace.  TRADE-SECRET MISAPPROPRIATION- COMPLETE DISMISSAL In two "Bet the Company" lawsuits, we represented a major manufacturer of SAS/SATA protocol analyzers.  These sophisticated devices are widely used in the semiconductor and electronic storage industry.  After aggressive discovery, motion practice, and an antitrust cross complaint, we obtained full dismissals in both suits, which were brought by the industry's two largest companies.  TRADE-SECRET MISAPPROPRIATION- COMPLETE DISMISSAL Represented an individual accused of misappropriating technology from the country's leading solar-heating manufacturer.  We obtained a complete dismissal after extensive discovery and mediation.  TRADE-SECRET MISAPPROPRIATION- INJUNCTION AND PAYMENT OF ATTORNEY FEES Represented one of the country's leading financial advisors which suspected a senior engineer of copying sensitive documents and software systems.  Worked with computer forensic specialists and uncovered the extent of the misappropriation and proceeded to file a complaint against the former engineer.  Successfully negotiated a settlement resulting in the complete return of all of the misappropriated software, a permanent injunction and judgment against the former employee, and the payment of the client’s legal fees totaling more than $100,000.  EMPLOYMENT ARBITRATION:  COMPLETE VICTORY Successfully enforced arbitration agreement on behalf of high net worth President and CEO accused of sexual harassment and discrimination, wrongful discharge, retaliation, failure to pay overtime and related claims.
